1. Bids are made in competition with other bidders bidding, on an alternating basis, in increments set by the auctioneer, as though the Bidder is present and the Bidder's purchase will be obtained at the lowest bid possible. In the event that the Bidder wishes to give Mack Auction Company permission to break a tied bid, the Bidder shall indicate by adding a (+) sign beside the bid price. In the event of a tie, this will authorize Mack Auction Company to increase the Bidder's bid by one increment. The Bidder understands that the item bid on will be sold to the highest bidder.
   
   
2. Proxy Bids are confidential prior to the Lot being sold and bidding will not commence with the highest Proxy Bid and a Proxy Bid is not considered the highest bid unless it has been reached by the alternating incremental basis set out in paragraph 1.
   
   
3. It is the Bidder's responsibility to arrange for the inspection of the item bid on prior to the auction sale. All items are sold "as is", "where is" and are at the risk of the buyer (Bidder) once the auctioneer has declared the item sold. The buyer (Bidder) is responsible for arranging delivery of the item purchased.
   
   
4. Mack Auction Company does not guarantee the year, hours, condition, description or suitability of any item or lot.
   
   
5. The Bidder acknowledges that the Proxy Bid is accepted on the express condition that the Bidder will not have any claim against Mack Auction Company, its employees or the Auctioneer if Mack Auction Company fails, for any reason, to bid on behalf of the Bidder.
   
   
6. Proxy Bids must be completed, submitted and received by Mack Auction Company before 6:00 A.M. on the sale date.
   
   
7. If successful in purchasing an item(s), the Bidder will be notified within 24 hours of the sale. Payment is required by cash, certified cheque or wire transfer immediately following notification of purchase. Items may only be removed after complete and full payment has been made.
   
   
8. The Bidder is responsible for proper financing arrangements prior to submitting the Proxy Bid form. The Bidder consents to permit Mack Auction Company to contact the above noted financial institution directly and make any inquiries deemed necessary by Mack Auction Company to establish Bidder's credit worthiness, and consents to disclosure of all such information to Mack Auction Company for such purpose.
   
   
9. GST and PST will be charged where applicable.
   
   
10. Proxy bids will only be taken on items over $300.00
